Trump will challenge court decision to deny him immunity in election case

Former US President Donald Trump’s team will appeal an appeals court ruling in the District of Columbia Circuit that ruled Trump is not immune from legal prosecution in a case involving his involvement in attempts to retain power despite his election defeat and riots on Capitol Hill.

“Unless the president has immunity from legal prosecution, every future president will be indicted by the opposition party when he leaves office. Without full immunity, the president of the United States will not be able to fully function,” Trump’s campaign team said in a statement. – President Trump strongly disagrees with the D.C. court’s ruling and will appeal it in order to protect the Constitution and the office of the presidency.”

The appeals court said in its decision that it could not “accept that the office of the presidency places those who previously held it above the law for all future time.”

On January 6, 2021, supporters of Trump, who was then head of state, stormed the Congressional building to prevent the results of the country’s November 2020 presidential election from being approved. They were won by Democrat Joe Biden.

During the unrest inside the building, a female demonstrator was shot and killed by police. There were unrelated deaths of several other people, qualified as medical emergencies. A Capitol Police officer died after the clashes.

U.S. special prosecutor Jack Smith in August 2023 announced four counts of indictments against Trump. He is actually charged with attempting to illegally retain power despite his defeat in the 2020 election.

The maximum penalty for the most serious of the crimes Trump is charged with is 20 years in prison. The politician’s defense has insisted that he is immune from legal prosecution for actions he took in the highest office of the state.
